What Are your thoughts on this article from PNS about the AARP disputing regulation of VoIP service?

One of Colorado’s largest consumer groups is hoping Gov. Ritter will think twice before signing a bill passed in the eleventh hour of the legislative session last week. The bill would prevent the state public utilities commission (PUC) from regulating voice-over-internet-protocol, better known as VOiP (VOYP) phone services.

Steve Merrill, Colorado Springs, is a volunteer advocate with AARP Colorado. He says that even though the PUC does not currently oversee VOiP, the bill would take away the state’s authority to be able to do so in the future – a move he says is not in the best interest of consumers.

“In the past, the PUC has played a vital and critical role in balancing the interests of the industries it regulates and the consumers that purchase the services.”

The bill was supported by Comcast and Qwest, who insist it would level the competitive playing field and lead to more consumer choice and telecom investment in Colorado. Merrill says both things would be likely to happen anyway.

“That’s a bogus argument on the part of Qwest Communications and the telecommunications industry. They will be here, they will invest and they will move forward.”

The proposal, HB 1281, also makes an already confusing landscape for telecommunications customers even harder to navigate, Merrill says.

“It muddies already murky waters for consumers seeking help when they have issues with telecommunications services.”

Merrill also worries that the bill could open the door to deregulation of traditional land-line service. The PUC currently regulates pricing and quality for land-line phone service; Merrill notes that VOiP is increasingly replacing land line service.

Clearing Up Misunderstandings

Although we have discussed this on this site previously, it seems there are still some misunderstandings about the FCC’s role in toll free practice. The FCC does not play a role in the assignment of numbers to subscribers, however they do regulate the guidelines under which 1-800 numbers can be used and obtained. For instance, the hoarding and warehousing of numbers is prohibited and punishable with severe fines—recently illustrated by a citation for an $11,000 fine each day a California company continued to implement improper toll free practices. Numbers are assigned by toll free carriers and phone companies.

Educate Yourself

As telecommunications experts, we are actively spreading the word about the scarcity of good toll free numbers. Are we succeeding? Business owners should be educated and prepared for the shortfall at a time when they may need the advantages of toll free the most. With the economy still floundering, this dearth of available 1-800 numbers comes at a time when economists are advising business owners to shift their marketing tactics to direct response—including using toll free to attract consumers and sustain relationships with existing customers. We know that toll free helps businesses. But getting good numbers, with supplies dwindling, is becoming a challenge. The best advice, still, is to obtain a good toll free phone number today.

Interesting Editorial For Discussion

Susan Crawford, a University of Michigan Law School professor and former special assistant to President Obama recently wrote an editorial for the New York Times, urging the FCC to reclassify ISPs as “telecommunications services” instead of “information services” This would backtrack a 2005 decision to deregulate the sector.
