Along with hoarding, the outright sale of specific toll free numbers is likewise illegal. Some crafty entrepreneurs have attempted to skirt the regulations by “leasing” or “renting” numbers. But industry insiders say the crackdown on illegal use of toll free numbers is aimed at this practice too.

Recent reports have referred to the situation as the ‘the perfect storm” meaning the shortage of numbers, the soaring demand, and the failure of the federal government to release reserved numbers have all collided to create a situation in which rationing, an embargo or even a complete depletion of 800 numbers is possible.

Rumors that a rationing program for the few remaining 800 numbers was imminent circulated through the telecommunications industry earlier this month. Supplies of 800, 888, 877, and 866 numbers are so depleted that availability is at an all-time low. But some say rationing the numbers, as the federal government did in 1995, is not the answer and could have a negative impact on the business community.

Previously, the system spared numbers throughout the day as their waiting periods expired, but users interested in reserving the number once it was spare never knew exactly when the number would be available. In response to this uncertainty, users often sent repeated queries on a number on the day it was supposed to go spare.

More than two-thirds of the available supply of 800, 888, 877, and 866 numbers are taken and millions of new subscribers are registering every year. The FCC does not play a role in the assignment of numbers to subscribers. However they do set and regulate the guidelines under which 800 numbers can be used and obtained. According to the FCC, hoarding and warehousing numbers is prohibited and punishable with severe fines.

By law, phone numbers cannot be sold or brokered. In 1997, the FCC made the sale of 800 numbers illegal. Because of the short supply of available numbers, complaints were pouring in at that time that price gouging for the popular numbers was becoming a common practice. The FCC acted quickly, prohibiting sales.

A recent plea for the deactivation of unused 800 numbers resulted in a surge of numbers returned to the main database. But despite these mass replacements, the supply of available toll free numbers continues to dwindle as thousands of subscribers register for a 1- 800 number each day.
